These Terms of Service ("Terms") govern your access to and use of the Family Emergency Plan Survey and resulting emergency plan (collectively, the "Service") provided by SU Consulting, LLC ("we," "us," or "our"). Please read these Terms carefully before using the Service.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the Service.

1. SERVICE DESCRIPTION

1.1 The Service consists of: (a) a survey designed to collect information about your household, potential emergency situations, and specific needs; and (b) the free or paid personalized emergency preparedness plans generated based on your survey responses (collectively referred to as "Emergency Plans").

1.2 The Service is intended solely for personal emergency preparedness planning and does not constitute professional emergency management services.

1.3 We do not guarantee that the Service will address all possible emergency scenarios or specific circumstances that may arise in an actual emergency.

2. USER ELIGIBILITY

2.1 You must be at least 18 years of age to use this Service.

2.2 By using this Service, you represent and warrant that you have the legal capacity to enter into these Terms.

3. PRIVACY AND DATA PROTECTION

3.1 Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

3.2 Information you provide through the Service will be used solely for the purpose of creating your personalized emergency preparedness plan.

3.3 We will not share your personal information with third parties except as required by law or as necessary to provide the Service.

3.4 Data Retention: We will retain your survey information for 1 year after the creation of your emergency plan, after which it will be deleted from our systems unless otherwise required by law. Your contact information will be retained for up to 7 years for business, legal, and administrative purposes, including updates to these terms of service or business communications.

4. USER RESPONSIBILITIES

4.1 You are responsible for providing accurate and complete information when using the Service. The effectiveness of your emergency plan depends on the accuracy of the information you provide.

4.2 You are responsible for regularly reviewing and updating your Emergency Plans to reflect changes in your household, location, or other relevant circumstances.

4.3 You acknowledge that your Emergency Plans should supplement, not replace, official guidance from local emergency management or emergency response agencies.

4.4 In case of an actual emergency, you agree to prioritize following instructions from official emergency responders and local authorities.

5. INTELLECTUAL PROPERTY RIGHTS

5.1 The Service, including its design, structure, methodology, and underlying technology, is owned by us and is protected by copyright, trademark, and other intellectual property laws.

5.2 You may freely share, modify, and adapt both the survey and your resulting Emergency Plans for personal or community preparedness purposes. However, you may not sell, license, or commercialize the survey, your Emergency Plans, or any derivative works without our explicit written permission.

5.3 Your specific input and customizations to your Emergency Plans belong to you, while the core content, structure, methodology, templates, formatting, and systems used to generate the Emergency Plans remain our intellectual property.

6. INDEMNIFICATION

6.1 By using this Service, you agree to indemnify and hold harmless SU Consulting, LLC, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including but not limited to attorney's fees) arising from or related to your use of the Service.

6.2 This includes any actions taken or not taken based on the information contained within the survey or the Emergency Plans generated through the Service.

7. LIMITATION OF LIABILITY

7.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SU CONSULTING, LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

7.2 We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

7.3 You expressly understand and agree that your use of the Service is at your sole risk.

8. MEDICAL DISCLAIMER

8.1 The Service is not a substitute for professional medical advice, diagnosis, or treatment.

8.2 Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or specific medical needs during emergency situations.

9. GOVERNING LAW AND JURISDICTION

9.1 These Terms shall be governed by and construed in accordance with the laws of New Mexico, U.S.A., without regard to its conflict of law provisions.

9.2 Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Bernalillo County, New Mexico, specifically in Albuquerque, and you consent to the personal jurisdiction of such courts.

10. SEVERABILITY

10.1 If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.

11. FORCE MAJEURE

11.1 We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, civil unrest, government action, power outages, or Internet disturbances.

12. CHANGES TO TERMS

12.1 We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 5 days' notice prior to any new terms taking effect.

12.2 Your continued use of the Service after any changes to the Terms constitutes your acceptance of such changes.

13. ELECTRONIC COMMUNICATIONS

13.1 By using the Service, you consent to receive communications from us electronically, including emails and notices posted on the Service.

13.2 You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

14. CHILDREN'S INFORMATION

14.1 The Service is not directed to children under the age of 13. If we learn that we have collected personal information from a child under 13 without verification of parental consent, we will take steps to remove that information from our servers.

14.2 If you provide information about children in your household as part of the emergency planning process, you represent that you are the legal guardian of such children and authorize us to process their information solely for the purpose of creating your family emergency plan.

16. ENTIRE AGREEMENT

16.1 These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.
